De regeling over de kapitaalschadecompensatie is te vinden in artikel 6.2.1 tot en met 6.3.3 van het decreet van 27 maart 2009 betreffende het grond- en pandenbeleid.; De voorwaarden, de randvoorwaarden en de wijze waarop de vergoedingen bepaald worden, zijn geregeld in het besluit van de Vlaamse Regering van 3 juli 2009 houdende de oprichting van de kapitaalschadecommissies en tot regeling van de kapitaalschadecompensatie.
